According to the parole board, prisoners appealing the ruling in their parole revocation hearings must first complete an administrative (internal) review before petitioning for a review from the courts.
According to Archie's attorney, Herman Frank, internal appeals generally take three to four months.
"By that time the whole thing will be moot," he said. "He will have served his time by then."
Steve Gargaro, an associate attorney assisting Franck with Archie's case, said the petition wasn't denied on the merits of the case, but because of administrative procedures.
"The reason we submitted it (the petition) now in the first place is because we felt the administrative appeal would take too long," Gargaro said Friday night during a benefit concert to raise money for Archie's legal fees.
Franck filed a motion with the Superior Court to reconsider the ruling, and also filed an appeal at the appellate level on Friday.
Franck said if the Appellate Court denies the appeal, the next step would be to petition the state Supreme Court.
"If we need to go, we'll go," he said.
